In New Hampshire, an SR‑22 (Certificate of Financial Responsibility) may be required when the Division of Motor Vehicles determines that a driver must provide proof of insurance following certain serious offenses, such as a DWI, leaving the scene of an accident, or a second reckless operation conviction. The requirement is communicated in writing, and the driver’s license, operating privileges, or vehicle registration cannot be restored until the SR‑22 is on file. The insurance carrier must be licensed in the state and must submit the uniform SR‑22 certificate; the DMV does not accept faxed copies, and the certificate can be either an “Owner” or “Operator” SR‑22 depending on whether the driver also needs vehicle registration.
The SR‑22 must remain in effect for a minimum of three years from the date of the final conviction or administrative action, with the same three‑year period applying to a second‑offense DWI. To reinstate a suspended license, the driver must provide the required SR‑22, satisfy any suspension period, and pay any reinstatement fees. Drivers who do not own a vehicle can obtain an Operator’s SR‑22, which covers the driver’s privilege only. If a driver believes they qualify for relief from the filing requirement, they may submit a written request to the Bureau of Financial Responsibility; a formal Notice of Relief of Filing will be issued if approved, and the insurance company will be notified of the relief.
